Strata Defect Week Continues with News of Another Major NSW Strata Defect Claim

Another short sharp pointer to interesting and newsworthy strata stuff …

I thought I had finished writing about strata building defects for a little while, when this news report from Josh Bavas at ABN News hits the headlines.

Apartment owners suing Sydney developer Toplace over dozens of 'defects' in near new Parramatta buildings

So, to quote Michael Corleone ‘ Just when I thought I was out, they pull me back in!’

It seems this 320 lot strata building started NSW Supreme Court legal action against Toplace in late 2018 for 45 different building defect typologies covering acoustic, fire and life safety, hydraulic, waterproofing, internal walls, electrical, mechanical, and, general matters.

You’ll remember Toplace as the developer of the Castle Hill strata complex that recently caught the NSW Building Commissioner’s attention [see my article ‘Serious Structural Faults: The New Normal in Strata Buildings’].

So, it seems that 3 years after this strata building was completed and 2.5 years after they started legal action, they’re still at the directions hearings stage and extending times for informal settlement discussions. That sounds like a long way from a hearing, decision, and getting compensation and the building defects fixed.

Something is seriously wrong with this system.
